AXIAS PHARMACY – STANDARD TERMS AND CONDITIONS OF SALE
These Terms and Conditions govern all sales, services, and deliveries made by Axias Pharmacy. By placing an order with us, the client agrees to the terms outlined herein. Any deviation from these terms must be explicitly agreed upon in writing by Axias Pharmacy.
1. Governing Principles
Axias Pharmacy is committed to providing safe, accessible, and timely healthcare solutions in compliance with Nigerian law and the guidelines of relevant regulatory bodies including the Pharmacists Council of Nigeria (PCN) and NAFDAC. We prioritize patient safety, integrity in dispensing medications, and professional conduct in all transactions.
2. Override of Client’s Terms
The client hereby expressly waives the application of its own general terms and conditions. These Terms and Conditions shall take precedence over any conflicting provisions unless otherwise agreed in writing and signed by both parties.
3. Payment Terms
All invoices must be settled within 5 working days from the date of issuance, unless otherwise stated on the invoice or agreed in writing. Failure to pay within the stipulated period may result in:
- A late payment interest of 10% on the outstanding balance.
- Suspension of further service or delivery without prior notice.
- Potential engagement of a debt recovery agency for amounts overdue beyond 30 days, with all recovery and legal costs borne by the client.
4. Withholding and Tax Obligations
Where applicable, any withholding tax or deductions mandated by local tax laws shall be the sole responsibility of the client. Invoices are expected to be paid in full, and Axias Pharmacy will not absorb costs related to a client’s national or local taxation.
5. Delivery & Shipping
We offer same-day delivery within 1–2 hours for orders received within our operating hours and within our delivery zones. Delivery timelines may vary due to weather, security, or other external factors. We will communicate any anticipated delays proactively.
6. Dispensing & Drug Safety
Axias Pharmacy dispenses medications strictly in line with Nigerian laws and professional guidelines. We reserve the right to:
- Request valid prescriptions where required by law.
- Refuse to dispense certain medications without necessary documentation.
- Record and verify customer data to comply with pharmacovigilance and regulatory requirements.
Clients are advised not to self-medicate and to seek professional medical consultation for all treatments. All medication dispensed is properly sourced, stored, and managed in line with safety standards.
7. Service Limitation & Liability
While we strive for accuracy, efficiency, and patient satisfaction:
- Our services do not constitute a guarantee of health outcomes.
- We shall not be held liable for indirect, incidental, or consequential damages.
- Axias Pharmacy shall not be required to join or represent clients in legal proceedings or disputes involving third parties or end-consumers.
8. Complaints and Claims
Any dissatisfaction or claim regarding goods or services must be reported to Axias Pharmacy in writing within 8 days of receipt. Please send complaints to our registered office or via email at info@axiaspharmacy.com. We are committed to addressing all valid concerns fairly and promptly.
9. Data Protection and Confidentiality
All customer and transaction data are handled with strict confidentiality and stored in compliance with data protection laws. We do not share or sell customer information.
10. Legal Jurisdiction
These Terms and Conditions and any dispute arising from them shall be governed solely by the laws of the Federal Republic of Nigeria. All disputes shall be resolved through mediation first before recourse to litigation.
